On June 29, 2022, Directive 2014/40/EU was amended by (EU) 2022/2100, which mainly revokes certain exemptions for heated tobacco products and takes effect on October 23, 2023. At present, we have received some feedback from the official request to update the submitted registration information; The materials submitted for subsequent registration need to comply with the new regulatory requirements.

This revision mainly involves two parts

1. Heated tobacco products are no longer exempt from the requirements of points 1 and 7 of Article 7, which currently require heated tobacco products to meet

a. Member States should prohibit the placing on the market of tobacco products with distinctive flavors;

b. Member States should prohibit any component of tobacco products containing flavoring agents, such as filters, paper, packaging, capsules, or any component that can change the technical characteristics of odor, taste, or smoke intensity, from being placed on the EU market. Filters, paper, and capsules must not contain tobacco or nicotine.

The requirements of Article 11 regarding specific labeling information and warnings exclude the exemption of heated tobacco products, which require them to carry the following information (Article 9, point 1, is the original requirement)

a) Article 9, point 1, general warning information. Each unit packaging and any outer packaging for smoking tobacco products should have one of the following general warnings:

b) Article 9, point 2:

Tobacco smoke contains over 70 substances known to cause cancer

c) Comprehensive health warning under Article 10, which includes

Smoking cessation information, such as phone number, email address, or internet website

One of the warning statements in Annex 1 below:

(1) Smoking causes 9 out of 10 lung cancer (90% of lung cancer is caused by smoking);

(2) Smoking causes more and throat cancer;

(3) Smoking damages your lungs;

(4) Smoking causes heart attacks;

(5) Smoking causes strokes and disability;

(6) Smoking clogs your arteries;

(7) Smoking increases the risk of blindness;

(8) Smoking damages your teeth and gums;

(9) Smoking can kill your unborn child;

(10) Your smoke harms your children, family, and friends;

(11) Smokers' children are more likely to start smoking;

(12) Quit smoking - stay alive for those close to you;

(13) Smoking reduces fertility;

(14) Smoking increases the risk of impotence.
